Two appeals are pending. The parties are briefing the appeals, expected to wrap up mid-2026. The Settlement says no payments can go out until the settlement becomes final, so both appeals must be resolved.
Possible oral arguments
The court may schedule oral argument. Not guaranteed. If held, late 2026 is the earliest likely window for the first appeal.
Ninth Circuit issues its ruling
The court could decide sometime in 2027 on one or both appeals. No deadline forces the court to act by a specific date. Either side can then seek further review.
Waiting periods and possible challenges
After the ruling, rehearing and Supreme Court petition windows must expire for both appeals, or any further review must be resolved. A rehearing request or Supreme Court petition can add months or more.
Administrator could begin if appeals resolve cleanly
If the appeals are rejected and the case becomes final in time, the administrator still has to verify claims, calculate amounts, and set up disbursement. That is not instant.
First payment arrives
Best case: 2028 payment cycle, if everything clears in time. Most likely: 2029. The first payment may include catch-up installments, with the rest paid annually through 2034.
