When will the House v. NCAA settlement start paying out?

House v. NCAA settlement: what has to happen before money hits your account

Now, 2026You are here

Ninth Circuit appeal is in progress

Two appeals are pending. The parties are briefing the appeals, expected to wrap up mid-2026. The Settlement says no payments can go out until the settlement becomes final, so both appeals must be resolved.

Late 2026

Possible oral arguments

The court may schedule oral argument. Not guaranteed. If held, late 2026 is the earliest likely window for the first appeal.

2027

Ninth Circuit issues its ruling

The court could decide sometime in 2027 on one or both appeals. No deadline forces the court to act by a specific date. Either side can then seek further review.

2027 to 2028

Waiting periods and possible challenges

After the ruling, rehearing and Supreme Court petition windows must expire for both appeals, or any further review must be resolved. A rehearing request or Supreme Court petition can add months or more.

2028

Administrator could begin if appeals resolve cleanly

If the appeals are rejected and the case becomes final in time, the administrator still has to verify claims, calculate amounts, and set up disbursement. That is not instant.

2028 to 2029+Most realistic

First payment arrives

Best case: 2028 payment cycle, if everything clears in time. Most likely: 2029. The first payment may include catch-up installments, with the rest paid annually through 2034.

2029

Scenario

Supreme Court review, remand, or extended administration

2030+

Actual timing and amounts depend on the settlement agreement, court orders, distribution plan, and administrator calculations. WARNING ABOUT POTENTIAL TAX CONSEQUENCES

Seller ("you") should seek advice from a registered tax preparer or competent tax advisor about your tax obligations for any payments that you are entitled to receive under the Settlement. However, the Court overseeing the Settlement has directed us to provide the following disclosure:

THE TAX CONSEQUENCES OF ANY AGREEMENT YOU SIGN REGARDING YOUR CLAIM MAY VARY DEPENDING ON THE SPECIFIC TERMS OF THAT AGREEMENT. WITH CERTAIN TRANSACTION STRUCTURES, YOU MAY BE REQUIRED TO PAY INCOME TAXES ON THE FULL AMOUNT OF THE PAYMENTS THAT YOU ARE ENTITLED TO UNDER THE SETTLEMENT (EVEN IF THE RESULTING TAX LIABILITY EXCEEDS THE AMOUNT YOU RECEIVED UNDER THE AGREEMENT).

A TRANSACTION STRUCTURED AS AN OUTRIGHT OR "TRUE" SALE MAY REMOVE FUTURE SETTLEMENT PAYMENTS FROM YOUR GROSS INCOME FOR FEDERAL AND STATE INCOME TAX PURPOSES, IN WHICH CASE YOU WOULD INSTEAD LIKELY PAY TAX ON THE PURCHASE PRICE YOU RECEIVE. AS A RESULT OF A SALE, YOU WOULD ALSO BE FORFEITING ANY AND ALL RIGHTS TO RECEIVE ADDITIONAL INCOME OR FUTURE PAYMENTS UNDER THE FOURTH AMENDED STIPULATION AND SETTLEMENT AGREEMENT, IN RE: COLLEGE ATHLETE NIL LITIGATION, NO. 4:20-CV-03919 (THE "SETTLEMENT AGREEMENT"). YOU SHOULD CONSULT WITH A COMPETENT TAX ADVISOR REGARDING THE SPECIFIC TAX CONSEQUENCES OF YOUR PARTICULAR AGREEMENT BEFORE SIGNING THE AGREEMENT.
